Do cap and ball muzzle loading pistols need to be shipped to a FFL dealer?

I am planning to sell my CVA Colonial cap and ball muzzle loading pistol. Can I just send it to the buyer or does it have to be sent to a FFl dealer?

NO- they DO NOT need any FFL - in MOST states. There are states that now require FFL for every gun including all muzzleloaders. IDK why ppl in those states allowed their elected officials to get away with that.

Depends on the state or city. Sometimes a seller or buyer will insist it be shipped to an FFL even if not required. There is no 4473 Form required regardless. Best to check with the jurisdiction you are shipping to, as certain anti-gun states or local governments do require FFL shipment for ALL guns, even muzzleloaders. This forum is getting nuts! A guy asks a simple question & the first two responses are political, instead of offering an answer. Edit: I want to mention that some C&B revolvers that can be converted to fire cartridges have the same shipping rules as modern handguns, so be careful.

What Hawkeye said. Check on local regulations on the receiving end. In general, the answer is no FFL needed according to Federal law

A question I must ask .With the new federal laws regarding (unmentionable ) 80% receivers to be in effect August this year and the muzzle loader question above will muzzle loader KITS now fall under the 80% law ? I have purchased several flintlocks and had them shipped direct but the 80% law will be a federal law ghost guns and all that stuff does any one have an idea?

In general, no, you do not need to send black powder guns to an FFL. In states like NJ, they treat black powder guns just like modern cartridge guns, so make sure to check your local laws.

All depends upon the State and or City the recipient lives in. In NJ and many other states, must ship to an FFL; if in PA like me, can be sent right to the address. Feds don't consider single shot muzzleloaders as "firearms", whereas the known anti-gun states do.

I'll also point out here that some stores, like Cabela's/Bass Pro Shops, have stopped shipping black powder guns period. A convicted felon a few years ago bought a black powder revolver from Cabela's, and murdered someone with it, and so the victim's family sued Cabela's for selling "a firearm" to a convicted felon.

As a result, Cabela's now won't ship them to your door - you must go to the store and pick up in person and fill out a "fake" 4473. It's just like a 4473 but it can't be submitted to NICS because they don't do background checks on black powder firearms. So it's all for show. You could just as easily lie/fill it out online but they no longer let you. You now have to go to a store in person to lie/fill out the form.

I am currently waiting for a kit to be sent. I would be just as concerned that the shipper , maybe ups, would destroy the package because it is a parts kit.

Generally in California, no FFL required BUT, in some Counties around San Francisco muzzleloaders must go thru an FFL.
Best to check the State where you're shipping so you know FOR SURE!!

???? In California, Muzzleloaders are NOT classified as firearms so NO FFL required.
BUT, some "liberal" Counties in the San Francisco Bay Area require Muzzleloaders to go thru FFL dealers. You pays your $$$ and you takes your chances.

The general rule of law is that states cannot create laws which are less stringent than federal laws on the same matter. They can, however, can have laws which are more stringent.

Funny story, I bought a T/C Flintlock through Gunbroker from a place in Illinois, and they told me they had to ship it to an FFL here in Arizona, well I bitched and moned for a week or so then finally the gun arrived at the gun shop and they called me to pick it up. So my son and I hopped in my truck(50 miles) and when to the store to pick it up, and while I was busy with the paperwork my son walked over to me with a used .32 TC Cherokee that he found on the used gun rack with a price tag of $199, well I was shocked, I quickly finished the paperwork bought the Cherokee and walked out of the store with a smile on my face and repeated what Alvin York once said THE LORD SURE WORKS IN MYSTERIOUS WAYS

All firearms in Illinois have to have a 4473 filled out. Even pellet rifles that fire over 750 FPS.
